Signature loans, or installment loans, are not regulated by the same law. Lenders that make installment loans can charge 27 percent interest on loans up to $2,910. This interest rate is similar to a high-interest credit card. However, signature loans can have a prepayment fee, which lets the lender charge you extra money if you pay the loan back early.
Payday loans are unsecured personal loans targeted at people who need money fast but don’t possess the type of credit or collateral required for a more traditional loan. Usually the only requirements to qualify for a payday loan are an active bank account and a job. Companies like MaxLend, RISE Credit, and CashMax have made an art out of providing high-interest loans to people who feel desperate and out of options.
In May 2008, the debt charity Credit Action made a complaint to the United Kingdom Office of Fair Trading (OFT) that payday lenders were placing advertising which violated advertising regulations on the social network website Facebook. The main complaint was that the APR was either not displayed at all or not displayed prominently enough, which is clearly required by UK advertising standards.
With a title loan, the amount you qualify for depends on an assessment of your car’s value. Loans range from a few hundred dollars to $10,000. A standard title loan is due in full after 30 days. This includes the finance charge, which can be as much as $125 for a $500 loan – that means you’ll pay $625 total when the loan is due. According to the Pew Charitable Trust, the average APR on title loans is around 300%.
The likelihood that a family will use a payday loan increases if they are unbanked or underbanked, or lack access to a traditional deposit bank account. In an American context the families who will use a payday loan are disproportionately either of black or Hispanic descent, recent immigrants, and/or under-educated. These individuals are least able to secure normal, lower-interest-rate forms of credit. Since payday lending operations charge higher interest-rates than traditional banks, they have the effect of depleting the assets of low-income communities. The Insight Center, a consumer advocacy group, reported in 2013 that payday lending cost U.S communities $774 million a year.
